Introduction

Austin Gamblers, LLC ("we," "us," or "our") operates the Austin Gamblers Kids Club (the “Kids Club”), a program designed for children between the ages of 3 and 12. Because the Kids Club involves the collection of personal information from children under the age of 13, we are required by the Children's Online Privacy Protection Act (“COPPA”) to obtain verifiable parental or legal guardian consent before collecting, using, or disclosing your child's personal information. This Registration Agreement and Parental or Legal Guardian Consent Form (this “Agreement”) describes the information we collect, how we use and protect it, your rights as a parent or legal guardian, and the choices available to you regarding your child's information. Parent or Legal Guardian means a child’s parent or any individual who has legal authority under applicable law to make decisions on behalf of the child, including consenting to the collection, use and disclosure of the child’s personal information.

By signing this Agreement, you represent that you are the parent or legal guardian of the child identified below and that you consent to the collection, use, and disclosure of your child's personal information as described herein.

1. Information We Collect.

In connection with your child's registration for the Kids Club, we collect the personal information below. We collect only the personal information that is reasonably necessary for a child to participate in the Kids Club and do not condition a child's participation on the disclosure of additional personal information beyond what is required for that purpose. We do not condition a child's participation in the Kids Club on the disclosure of more personal information than is reasonably necessary for that purpose.

  1. Information About the Child: First and last name, date of birth, email address (if the child has one), shirt size, and mailing address.
  2. Information About the Parent or Legal Guardian: First and last name, email address, and mailing address.

We do not condition a child’s participation in the Kids Club on consent to receive marketing communications from the Sponsor.

2. How We Use the Information.

We use the personal information collected through the Kids Club registration for the following purposes:

  1. To register your child as a member of the Kids Club and to administer your child's participation in the Kids Club, including distributing club merchandise (such as t-shirts in the appropriate size), sending mailings related to Kids Club activities, and communicating with you and your child about upcoming events, promotions, and other Kids Club-related information.
  2. To communicate with you, the Parent or Legal Guardian, regarding your child's participation in the Kids Club, to respond to your inquiries, and to provide you with notices required by law.
  3. To comply with applicable legal obligations, including those imposed by COPPA.

If a child’s email address is collected, it will be used solely for Kids Club-related communications and will not be used for targeted advertising or independent marketing purposes.

3. Disclosure of Information to Third Parties.

We may share certain personal information collected through the Kids Club with Scheels All Sports, Inc. (the “Sponsor”), a third-party sponsor of the Kids Club. Specifically, the information that may be shared with the Sponsor includes the Parent's or Legal Guardian’s email address and the child's email address (if one was provided), first and last name, and mailing address.

The Sponsor may use this information to send promotional materials, special offers, and other marketing communications related to the Sponsor's products and services. The Sponsor is contractually prohibited from using the information for any purpose other than those described in this Agreement, from further disclosing or selling the information to any other third party, and from contacting a child directly, using the child’s personal information, without the Parent’s or Legal Guardian’s express consent and direction. The Sponsor is also contractually required to maintain reasonable security measures to protect the information and to comply with COPPA and all other applicable privacy laws.

The Sponsor may use Parent or Legal Guardian contact information to send marketing communications where consent has been provided. Any communications directed to a child will be limited to Kids Club-related messaging and will occur only as directed by the Parent or Legal Guardian.

Your consent to the disclosure of information to the Sponsor is separate and optional. You may consent to the collection of your child's personal information for purposes of Kids Club participation without consenting to the disclosure of information to the Sponsor. Please indicate your preference in Section 8 below.

Your decision regarding sponsor communications will not affect your child’s ability to participate in the Kids Club. The Sponsor is not permitted to sell, rent, or otherwise disclose personal information received through the Kids Club to any other third party

4. Data Retention and Deletion.

We retain personal information collected through the Kids Club only for as long as is reasonably necessary to fulfill the purposes described in this Agreement or as required by applicable law. When personal information is no longer needed, we will securely delete or de-identify it in accordance with our data retention policies.

You may request the deletion of your child's personal information at any time by contacting us using the contact information provided at the top of this Agreement. Upon receipt of a verified request, we will promptly delete the child's personal information from our records and direct the Sponsor (if applicable) to do the same, unless retention is required by law.

We retain children’s personal information only for as long as reasonably necessary to fulfill the purposes described in this Agreement and to comply with applicable law.

5. Security.

We maintain reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect from unauthorized access, use, alteration, or destruction. While no system of data security is entirely impenetrable, we take commercially reasonable steps to ensure that personal information is protected in accordance with applicable law.

6. Your Rights as a Parent or Legal Guardian.

Under COPPA, you have the rights listed below. To exercise any of these rights, please contact us at dataprivacy@austingamblers.com. We may require you to verify your identity as the child's Parent or Legal Guardian before processing your request.

  1. Right to Review. You may request to review the personal information we have collected from your child by contacting us at the address, phone number, or email address listed at the top of this Agreement. We will verify your identity before providing access to any personal information.
  2. Right to Revoke Consent. You may revoke your consent to the further collection, use, or disclosure of your child's personal information at any time by contacting us. If you revoke consent, we will stop collecting personal information from your child and will delete the information previously collected, subject to any legal obligations requiring retention. Please note that revoking consent may result in your child's inability to continue participating in the Kids Club.
  3. Right to Request Deletion. You may request at any time that we delete the personal information we have collected from your child. We will comply with verified deletion requests promptly and will direct the Sponsor and any service providers to delete the information as well.
  4. Right to Refuse Disclosure to Third Parties. You may consent to the collection and use of your child's personal information without consenting to its disclosure to the Sponsor. Your decision regarding third-party disclosure will not affect your child's ability to participate in the Kids Club.

7. Changes to This Agreement.

We may update this Agreement from time to time to reflect changes in our practices or applicable law. If we make material changes to how we collect, use, or disclose your child's personal information, we will provide you with prior notice by sending a new direct notice and consent form to the email address or mailing address you have provided. We will not retroactively apply material changes to information already collected without first obtaining new verifiable Parent or Legal Guardian consent.

8. Parent or Legal Guardian Consent.

By signing below, I acknowledge that I have read and understand this Agreement, including the Kids Club Privacy Policy, and I confirm the following:

  1. Required Consent to Participation in the Kids Club. I hereby consent to the collection and use of my child's personal information, as described in Sections 1 and 2 of this Agreement, for the purpose of my child's registration and participation in the Kids Club.
  2. Optional Consent to Receive Marketing Communications from the Kids Club Sponsor. I understand that my consent to disclosure of information to the Sponsor is voluntary and is not required for my child's participation in the Kids Club. I selected my consent preference prior to purchase.

I understand that this consent applies to personal information collected through the Kids Club registration process, including any follow-up forms, communications, or systems used to complete my child’s enrollment. I am the Parent or Legal Guardian of the child identified below and I understand that Austin Gamblers, LLC will collect, use, and maintain my child's personal information as described in this Agreement for the purpose of administering the Kids Club.
